While battling TLC in a breach of contract lawsuit, Jon says the reason he can't simply go out and get a regular job is because he's too famous!

Several of TLC’s long-time advertisers complained to the network about Jon Gosselin’s “erratic, widely publicized behavior,” according to court papers obtained exclusively by RadarOnline.com.

These complaints and Jon’s continuing breach of his contract caused the network to decide to change the show to Kate Plus 8, the papers reveal.

An affidavit from Edward Sabin, executive vice president and chief operating officer of TLC, contains new and damaging charges against Jon Gosselin and his representatives.

RadarOnline.com obtained the information from the Montgomery County, MD court file in TLC’s breach of contract lawsuit against Jon.

The affidavit reveals many of the terms of the Gosselins’ contract with the network and details numerous breaches by Jon. And despite Jon’s claims that he didn’t have adequate representation, it states the contract was signed in June, 2008 “after extensive negotiations, during which the Gosselins were represented both by an attorney and their manager.”

The court file also reveals that CBS has admitted to TLC Jon was paid to appear recently on two of their programs – also a violation of his contract.
As RadarOnline.com reported exclusively, Jon will be questioned under oath when TLC’s motion for a preliminary injunction against Jon is heard on December 14.

RadarOnline.com has now learned that Jon will be questioned by Paul Gaffney, a partner in Williams & Connolly, the Washington, D.C. law firm with a “scorched earth” reputation.

In h is affidavit Sabin also says that Jon refused to cooperate with TLC’s filming schedule and that on the day the network decided to change the show, Jon’s lawyer demanded release from the exclusivity provision of the contract but still wanted to be paid.
“Mr. Heller informed TLC’s representative that if this release was not forthcoming within an hour, Mr. Gosselin would object in public fashion to any further filming of his children.”
The preliminary injunction sought by TLC would prevent Jon from violating the exclusivity, non-endorsement, confidentiality, and publicity provisions of his contract with TLC.

Not so fast, Jon Gosselin!
Despite the fact that his lawyer Mark Heller said Jon was in “complete compliance” with a court order that required him to return $181,000 he took from the couple’s joint bank account, Kate’s lawyer tells RadarOnline.com that’s not true.
Mark Momjian revealed to RadarOnline.com that Jon has only put back $28,500!

Heller said earlier Friday that Jon had put back the money but that’s not so, says Kate’s lawyer Momjian, who also questions why Heller is speaking for Jon.
Momjian told RadarOnline.com: “Mr. Heller doesn’t represent Jon Gosselin in the divorce action in state of Pennsylvania so it’s a little puzzling to us why he’s making statements on a case he is not counsel of record on.

“He’s withdrawn his application to be admitted specially in Pennsylvania.
“All I can tell you is Jon Gosselin has until Monday to put all the money back and we hope he complies.

The money was supposed to be sent into wife’s counsel escrow account and $28,500 has only been confirmed as of now.

Momjian also said: "My client would be relieved to report that he (Jon) has fully complied...I would be relieved, too!
"But he hasn't as of now."

UPDATE: Momjian also told RadarOnline.com: "We got an email at 1:23 (ET) this afternoon saying that Jon Gosselin purportedly had sent $152,000 to his lawyer in Pennsylvania.
"The money had not come to us yet, per the court order's directive. Jon's lawyers is making a representation that the money is with him; the court order required that the money is to go to us. We're waiting for it."
Jon’s lawyer had said earlier Friday that Jon was in compliance with the court order. But, as Momjian points out Jon is not in compliance and won’t be until the money is in the account.
Momjian told RadarOnline.com that that Jon has until Monday to be in compliance "but he is not in full compliance as of yet."

In the new issue of Vanity Fair Kate talks about the pressure on her children from the divorce and media attention as mom and dad bat accusations back and forth on national TV about each other's bad behavior. Kate says about the kids: "I'm trying to give them the grace to see, if they're acting out of line, I'm trying to look deeper into why that is. Why the kids are acting out. Cause it's all inter-related. I mean, they don't see it, but it's all interconnected."

And while Kate has figured out that it's all connected to mommy accusing daddy of stealing money on national TV, and daddy saying he despises mommy, also on national TV, the Vanity Fair article does not paint the most flattering portrait of her.

At one point, the writer describes a scene where Kate is shopping and being followed by photographers. When the writer asks one photographer why he's following Kate, the photog says: "She's a massive story at the moment," he whispers.

That shocking charge comes from a new Vanity Fair article on Jon and Kate, an article that portrays both parents in less-than-flattering terms while discussing the public frenzy surrounding their divorce.
The article also confirms a RadarOnline.com exclusive, that the marriage was over more than six months before the couple announced it.

Vanity Fair says that a source close to Jon revealed Jon wanted to keep the marriage together and asked Kate to go to counseling but she would only agree to see Dr. Phil. According to the magazine he said: “Are you crazy? I’m here to save my marriage and you’re talking about my brand?”

The show pulled in 2.5 million viewers for Monday's original episode, continuing a recent upward trend.
The week before 1.7 million viewers tuned in and prior to that 1.3 million people watched.
TLC is trying to squeeze out a few more episodes. RadarOnline.com broke the story Wednesday that the show will end in mid to late November.

Jon & Kate Plus 8 will officially end in mid to late November, RadarOnline.com has learned exclusively.
TLC has not made an announcement but RadarOnline.com has confirmed with sources outside the network that there is just enough unused new footage to take them through about another month.

"They will eek out what they can in terms of more shows," a source close to the situation told RadarOnline.com. "Obviously they are not shooting anymore so they are taking what they have and seeing how many more episodes they can get out of it."
Jon Gosselin has told the network they no longer have his permission to film the children and TLC will not challenge that. If Jon changes, his mind, they will go into production on the new show, Kate Plus 8.

"TLC has no plans to film unless the situation is resolved," the source told RadarOnline.com.
